1) Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of hialeahparkcasino.com and any related pages, features, mobile experiences, and services we provide (collectively, the “Services”). The Services are operated by South Florida Racing Association, LLC, doing business as Hialeah Park Casino (“Hialeah Park Casino,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy (and any other rules posted for specific promotions, events, or offerings). If you do not agree, do not use the Services.

2) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and change the Effective Date. Your continued use of the Services after changes become effective means you accept the updated Terms.

3) Eligibility and Age Requirements

You must be at least 18 years old to use the Services generally. Certain areas, content, benefits, promotions, or on-property activities may require you to be 21 years of age or older (or another minimum age required by applicable law). You are responsible for ensuring you meet any age and legal eligibility requirements.

4) No Guarantee of Availability

We may suspend, modify, or discontinue any part of the Services at any time, temporarily or permanently, with or without notice. We do not guarantee the Services will be available at all times or error-free.

5) Accounts, Registration, and Security

Some features may require you to create an account. When you create an account, you agree to:

  • Provide accurate, current information and keep it updated;
  • Maintain the confidentiality of your login credentials;
  • Notify us promptly of any unauthorized use of your account.

6) House Rules, Promotions, and Additional Terms

Certain Services—such as promotions, drawings, giveaways, tournaments, offers, or loyalty benefits—may be governed by additional rules (“Promotion Rules”). Promotion Rules are incorporated into these Terms by reference. If Promotion Rules conflict with these Terms, the Promotion Rules control for that specific promotion or offer.

We reserve the right to modify, suspend, revoke, or cancel any promotion or offer at any time as permitted by law, including for suspected fraud, abuse, or eligibility issues.

7) Gaming and Wagering Disclosures

Hialeah Park Casino operates gaming, pari-mutuel, and related entertainment offerings pursuant to applicable Florida law and regulatory requirements. The Services may include informational content about on-property offerings, events, and promotions.

Unless explicitly stated on the Services, the Services are not an online wagering platform. If any portion of the Services ever includes wagering-related features, those features will be governed by additional terms and may require identity, age, and/or location verification, where applicable.

8) Payments, Purchases, and Refunds

If the Services allow you to make purchases (e.g., tickets, reservations, merchandise, dining, event packages, or other items), you agree that:

  • You will provide valid payment information and authorization;
  • All sales may be final except as required by law or as stated in the applicable purchase terms;
  • We may cancel or refuse orders in our discretion (e.g., suspected fraud, pricing errors, inventory limits).

Refund policies (if any) may vary by item or event and will be disclosed at the point of purchase or in applicable terms.

9) Prohibited Conduct

You agree not to:

10) User Content (If You Submit Anything)

If you submit, post, upload, or transmit content through the Services (e.g., forms, reviews, messages, images) (“User Content”), you represent that you have the rights to do so and that it does not violate law or third-party rights.

You grant us a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, modify (for technical purposes), and display User Content solely as needed to operate, improve, and promote the Services (unless otherwise restricted by law or our Privacy Policy).

We may remove User Content at any time in our discretion.

11) Intellectual Property

The Services, including all text, graphics, logos, designs, photos, videos, software, and other materials (“Content”), are owned by Hialeah Park Casino or its licensors and are protected by intellectual property laws.

You may use the Services for personal, non-commercial use only. You may not copy, reproduce, distribute, create derivative works, publicly display, or exploit any Content without our prior written permission, except as allowed by law.

13) Disclaimers

THE SERVICES AND CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee the accuracy, completeness, or reliability of information on the Services, including event schedules, promotions, prize details, or availability, which may change.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIALEAH PARK CASINO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.

TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US THROUGH THE SERVICES IN THE PRIOR TWELVE (12) MONTHS, WHICHEVER IS GREATER, UNLESS APPLICABLE LAW REQUIRES OTHERWISE.

15) Indemnification

You agree to indemnify, defend, and hold harmless Hialeah Park Casino and its affiliates, officers, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services, (b) your violation of these Terms, (c) your User Content, or (d) your violation of any law or third-party rights.

16) Termination

We may suspend or terminate your access to the Services at any time for any reason, including suspected fraud, security concerns, or violations of these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

17) Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict of laws rules. Except where prohibited by law, you agree that any legal action arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction there.

19) Miscellaneous

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver: Our failure to enforce a provision is not a waiver.
  • Assignment: You may not assign your rights under these Terms without our consent; we may assign these Terms as permitted by law.
  • Entire Agreement: These Terms and referenced policies/rules constitute the entire agreement regarding the Services.
